CMS Emergency Preparedness

On September 8, 2016, the Center for Medicare and Medicaid Services (CMS) announced new regulations that are required for all participating health care providers to develop and implement Emergency Preparedness plans.


Health care providers and suppliers affected by this rule must comply and implement all regulations one year after the effective date, on November 16, 2017.


Failure to implement these regulations may make you ineligible to continue receiving CMS funding.

These rules apply to:

  • Ambulatory Surgical Centers
  • Critical Access Hospitals
  • Clinics, Rehabilitation Agencies, and Public Health Agencies as Providers of Outpatient Physical Therapy and Speech-Language Pathology Services (Organizations)
  • Community Mental Health Centers
  • Comprehensive Outpatient Rehabilitation Facilities
  • End-Stage Renal Disease Facilities
  • Home Health Agencies
  • Hospitals
  • Hospices
  • Intermediate Care Facilities for Individuals with Intellectual Disabilities
  • Long-Term Care Facilities
  • Procurement Organizations
  • Programs of All-Inclusive Care for the Elderly
  • Psychiatric Residential Treatment Facilities
  • Rural Health Clinics and Federally Qualified Health Centers
  • Religious Non-medical Health Care Institutions
  • Transplant Centers
